MEMORANDUM OF UNDERSTANDING ON PUBLIC SERVICE IN THE COMMONWEALTH CARIBBEAN COUNTRIES (1970)
 

BETWEEN the Governments of Antigua, Bahamas, Barbados, Belize, Dominica, Grenada, Guyana, Jamaica, Montserrat, St. Kitts-Nevis-Anguilla, St. Lucia, St. Vincent and Trinidad and Tobago (hereinafter referred to as "the Governments"):

DESIRING to give effect to the proposals of the Fifth Conference of Heads of Government of Commonwealth Caribbean Countries held at Port-of-Spain, Trinidad, February, 1969 relating to the Public Service in the Commonwealth Caribbean Countries.

THE GOVERNMENTS REFERRED TO ABOVE IN A SPIRIT OF FRIENDLY CO-OPERATION HAVE AGREED AS FOLLOWS:

1. To accept the principle that Commonwealth Citizens of the West Indian origin should be eligible for appointment to the Public Services of all Commonwealth Caribbean Countries.

2. That a scheme be formulated to facilitate the transfer of Officers from the Public Service of one Commonwealth Caribbean Country to the Public Service of another.

3. That Governments should provide for the retention of pension rights of officers who are transferred from the Public Service of one Commonwealth Caribbean Country to the Public Service of another.

4. That the scheme should apply in respect of transfers only where the Government of the country from which the Officer is transferred concurs in the transfer.

5. That the scheme should be confined to transfers of officers from the Public Service of one country to the Public Service of another country, and should not in the first instance include transfers between Government Corporations and regional Public Services.

6. That special arrangements need to be made whenever it is agreed that the scheme should apply mutatis mutandis to transfers or secondments of public officers to or from approved regional bodies.

7. That Governments undertake to examine existing legislation in the region with a view to the preparation of uniform pension laws.

8. That whenever a Government decides to recruit an officer for appointment from outside of its own territory and within the region, that Government should inform the other Governments of such requirements and wherever possible, at least three months before the commencement of the year to which the requirements relate.

9. That Governments, in order to ensure the most efficient administration of the principles enshrined in this Memorandum, undertake to implement at a national level the necessary legislative changes to give effect to the provisions of this Memorandum.

10. That this Memorandum shall take effect upon signature by nine Governments.

11. That this Memorandum may be modified by agreement of all participating Governments but such modification shall be without prejudice to the rights of officers, if any accrued pursuant to it.

12. That any Government may withdraw from participation in this scheme by written notice to the Commonwealth Caribbean Regional Secretariat. Such withdrawal shall take effect at the end of twelve (12) months from the date of the receipt of the notice and shall be without prejudice to the rights of officers, if any, accrued thereunder.

IN WITNESS WHEREOF the undersigned representatives, being duly authorised thereto by their respective Governments have signed the present Agreement.

Done at Georgetown the 25th day of November, 1970 in a single copy, which shall be deposited with the Commonwealth Caribbean Regional Secretariat by which certified copies shall be transmitted to all participating Governments.
